Hachette Filipacchi (UK) Limited: Terms and Conditions of Website Use
Your agreement with Hachette Filipacchi (UK) Limited, its subsidiaries and affiliated companies (“Company” or “Hachette”) is made up of (i) the Terms and Conditions of Website Use, (ii) the Privacy Policy, (iii) any forum or community guidelines, and (iv) any other documents governing your use of the Site, as defined below (“Terms”). These Terms shall govern the Elle Decoration network located at www.elledecoration.co.uk and its related domains (“Site”). By registering, accessing, browsing and/or using the Site you acknowledge and agree to be bound by the Terms, which shall take effect immediately on your first use of the Site. If you do not agree to the Terms please do not register, access, browse or use the Site.
Hachette may change the Terms from time-to-time. Please check the Terms regularly for the posting of any updates or revisions. Your continued use of the Site constitutes acceptance of these updates or revisions. If you do not agree to these changes you should cease using the Site. Hachette’s General Competition Terms and Conditions appear after section 9 of these Terms.
1. COPYRIGHT AND OTHER RIGHTS
1.1. All copyright, trademarks, design rights and all other intellectual property rights (registered or unregistered) in and on the Site and all and content located on the Site shall at all times remain vested in the Company or our licensors (which includes other users).
1.2. Hachette grants you a limited, non-exclusive, revocable, non-transferable licence to use the Site content solely for personal use relating to your use of the Site. Except as expressly set out herein, neither you nor anyone acting on your behalf acquires any intellectual property rights relating to any Site content. Any rights not expressly granted within these Terms are reserved.
1.3. You may not and agree not to assist or facilitate any third party to copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, transmit , distribute, broadcast, commercially exploit, create derivative works, make available to the public or otherwise use the Site content or Site in any way except for your personal, non-commercial use. Any other use of the Site content or Site requires prior written permission of Hachette. If you become aware of any such distribution or commercial exploitation, you agree to notify us immediately.
1.4. Nothing in these Terms shall be construed as conferring any licence or right under any intellectual property right of Hachette or any third party unless expressly stated.
1.5. The names, images and logos identifying Elle Decoration, its parent company, affiliated companies and their products and services are the copyright, design right or trademarks of Elle Decoration, its parent company or affiliated companies. Nothing in these Terms shall be construed as conferring any licence or right to use any trademark, design right or copyright of such parties.
1.6. By sharing any contribution(s) with us (including data, text, photo, message, posting, image, logo, attachment, hyperlink and all other content (collectively “Contribution(s)”)) to the Site, you agree and grant Hachette and its sub-licensees, free of charge permission, to use the Contribution(s) in any way Hachette wants (including modifying and adapting it for operational and editorial reasons) in connection with the operation of the Site and our business. The licence extends to copying, distributing, broadcasting or otherwise transmitting, adapting or editing the Contribution(s).
1.7. You agree and confirm that any Contribution(s) you provide or upload is original to you and does not infringe UK laws, copyright or other rights of any other person, or that you have the consents necessary to provide the Contribution(s) to Hachette, including the consent of anyone who is identifiable in your Contribution(s) or the consent of their parent/guardian if they are under 16.
1.8. If you do not want to grant us the permission set out in these Terms, please do not share your Contribution(s) with us.
2. HACHETTE’S RESPONSIBILITIES
2.1. Hachette reserves the right to remove or edit any Contribution(s) which is found to be in breach of the Terms as set out herein.
2.2 Hachette will endeavour to provide the Site using all reasonable care. The Site is provided “as is” and on an “as available basis” and to the extent permitted by law, Hachette excludes all implied warranties as to quality, accuracy, fitness for purpose and makes no guarantee, representation or warranty: (i) with respect to the Site or your use of the Site, (ii) that the Site will be accessible, useable, uninterrupted, timely, secure or free of errors, viruses or bugs , (iii) to the accuracy, timing or reliability of any information, opinion, advice, Contribution(s) or statements contained herein, or (iv) that the Site is compatible with any software of material.
2.3 You acknowledge that Hachette does not endorse the accuracy, integrity, copyright, compliance, legality, quality or decency of any Contribution(s). Users (including Elle Decoration representatives) may respond to or comment upon Contribution(s), such comments do not necessarily represent the views or opinions of Hachette.
2.4 If you have any claim arising from the actions or statements of another user, you agree to pursue such a claim only against that user and not Hachette.
2.5 Hachette shall not accept responsibility or liability for any damage, loss, injury, disappointment suffered as a result of: (i) your use of (or inability to use) the Site, (ii) any changes Hachette makes to the Site, (iii) any permanent or temporary cessation in the provision of the Site (or any feature within the Site), or (iv) the deletion, corruption or failure to store any Contribution(s) and any other communications data maintained or transmitted through your use of the Site, (v) the performance of the Site.
2.6 Hachette will not be liable for the following losses or damage, regardless of the form of action for: (i) loss of use of the Site, (ii) damage to equipment or other software, (iii) loss of data, (iv) loss of revenue or anticipated profits, (v) loss of opportunity, (vi) loss of goodwill or injury to reputation, (vii) losses suffered by third parties or (viii) for any indirect, special, exemplary or consequential damages, Nothing in these terms and conditions shall exclude or limit our liability for death or personal injury resulting from the negligence of us, our servants, agents or employees.
3. YOUR USE OF THE SITE
3.1 Hachette insists that any use by you of the Site shall be in accordance with the following conditions: (i) If you are a child or a young person under the age of 16, you are required to obtain your parent’s or guardian’s permission before using the Site. Parents or guardians who wish to allow their children to access to the Site should supervise their access to the Site, as their legal guardian it is your responsibility to determine whether any of the Site is appropriate for your child. (ii) You are responsible for all activities undertaken by you using any service provided by us, including access to materials on the internet (whether it is a password protected site or not) and use of the email. All activities are at your own risk. (iii) You will not use the Site or any other services provided through the Site in a manner or for a purpose contrary to these Terms. (iv) You are responsible for all activities under your password or account, and you will keep your password confidential. You will immediately notify us of any unauthorised use of your password or account or any other breach of security. You will not disrupt the functioning of the Site, solicit or use another user’s password or otherwise act in a way that interferes with other users’ use of the Site.
3.2 You agree you will not: (i) defame, threaten, stalk, abuse, harm or otherwise harass other users; (ii) use the Site in any manner which could damage, disable, overburden or impair the Site (or the networks connected to such site or services) or interfere with any other party’s use and enjoyment of the Site; (iii) attempt to gain unauthorized access to the Site, other accounts, computer systems or networks connected to the Site, through hacking, password mining or any other means; (iv) obtain or attempt to obtain any materials or information through any means not intentionally made available to you through the Site; (v) register more than one user account, or register for a user account on someone else’s behalf or on behalf of any group or entity; (vi) post, publish, modify, transmit, communicate, reproduce, or distribute in any way, information, software or other materials or tools designed for compromising the security of the Site or our network; (vii) advertise or offer to sell or buy any goods or services for any business purpose, unless such service specifically permitted by Hachette; (viii) download any file posted by another user that you know, or reasonably should know, should not or cannot be legally distributed in such manner; (ix) falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of material or otherwise disguise the origin of such material; or (x) impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity, or create a false identity to mislead others.
3.3 You agree you will not upload, publish, post, communicate, transmit or otherwise make available any material (including but not limited to Contribution(s)): (i) for any unlawful purpose or in any unlawful way; (ii) which may encourage criminal conduct; (iii), which is or contains unsolicited, unauthorised advertising, promotional materials with surveys, contests, “pyramid schemes”, “chain letters”, “junk mail”, “spam” or any other form of duplicative or unsolicited communications (commercial or otherwise); (iv) which is inappropriate, profane, infringing, fraudulent, hateful, obscene, indecent, unlawful, racially, ethnically or otherwise objectionable or offensive; (v) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment (including Trojan horses, worms, time bombs, cancelbots or corrupted files) or interfere with or expropriate any system data or personal information; (vi) that is harmful or pornographic or which would violate or infringe in any way upon the rights of others (including intellectual property rights, rights of confidentiality, or rights of privacy) or cause distress or inconvenience; or (vii) that refers to third parties by name.
3.4 Should Hachette become aware of any activity that would be contrary to the Terms or determine in their sole discretion to be unacceptable, then Hachette reserves the right to take action including temporary or permanent removal of content, filtering of internet transmissions and/or to exclude the User with immediate effect and, where necessary, to forward any incriminating material in its possession to the UK police or other relevant authorities.
3.5 You accept that Hachette may keep a record of your IP and/or host address for reference purposes only (in order to keep a track on the amount of visitors per day). In the event of any breach of these Terms, Hachette may view and add your IP and/or host address to an ‘excluded database’ to prevent you gaining further access to the website service. These addresses are not distributed or given out to any third party services.
4. OTHER PARTY’S PRODUCTS AND SERVICES AND LINKS
4.1 The Site may include hyperlinks to other websites that are not owned or controlled by Hachette. Hachette has no control over, nor assumes responsibility for, the availability, content, privacy policy or practices of these websites.
4.2 If you decide to visit any linked website, you do so at your own risk and it is your responsibility to take all measures to guard against viruses or other destructive elements. Any terms, conditions, warranties or representations contained within and associated with other websites are between you and the relevant provider of the service. Hachette encourages you to be aware when you leave the Site and to read the terms and conditions and privacy policy of each other website that you visit.
4.3 You acknowledge and agree that Hachette is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any content, advertising, products, services or information on or available from such websites or resources.
4.4 You acknowledge and agree that Hachette is not responsible for the availability of those external sites or resources and does not endorse any advertising, products or other products or materials on or available from such website or resources.
4.5 Hachette disclaims all liability for any legal or other consequences (including infringement of third party rights) of links made to the Site.
4.6 Links do not imply that Hachette is legally authorised to use any trademark, trade name, logo or copyright displayed in and accessible through the links or that any linked website is authorised to use any trademark, logo or copyright of Hachette. Hachette reserves the right to request that any links you create are removed at any time and you agree to comply with any request.
4.7 This Site may contain or refer to third party sources of information, articles, photographs, text, graphics, pictures, designs, music, video, applications, hardware, software, products or services owned by or originating from third parties (“Third Party Products and Services”). Hachette provides Third Party Products and Services and information to you only as a convenience and any reference to Third Party Products and Services does not imply an endorsement or association with the third party in any way. Your use of Third Party Products and Services shall be governed by and subject to you agreeing to the terms of separate licenses and other agreements except where such Third Party Products or Services are covered by license or other agreement with Hachette.
4.8 Installation or use of Third Party Products and Services with Hachette’s products and services may require one or more patent, trademark, copyright or other licenses in order to avoid infringement or violation of third party rights. You are solely responsible for determining whether to use Third Party Products and Services and if any third party licenses are required to do so. If required, you are responsible for acquiring them. You should not install or use Third Party Products and Services until all necessary licenses have been acquired. Any Third Party Products and Services that are provided with Hachette’s products and services are provided as a convenience to you and are provided AS IS with no express or implied conditions, endorsements, guarantees, representations or warranties of any kind by Hachette and Hachette assumes no liability whatsoever, in relation thereto. Prior to subscribing for, installing or using any Third Party Products and Services it is your responsibility to ensure that your service provider has agreed to support all of the features of the Third Party Products and Services.
4.9 Any dealings with third parties conducted through the Site or linked websites, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the third party. Hachette shall not be responsible or liable for any part of any such dealings.
4.10 The terms of use of any Hachette product or service are set out in a separate license or other agreement with Hachette applicable thereto. Nothing in these Terms is intended to supersede any express written agreements or warranties provided by Hachette for any Hachette product or service.
5. INDEMNITY
You hereby agree to indemnify Hachette, its employees, representatives, from any and all claims, liability, damages, costs and expenses (including legal fees) which arise from: (i) your statements, Contribution(s) or any other submissions to or through the Site; (ii) your use or misuse of the Site; (iii) your violation of third party rights; (iv) any other liabilities arising out of your use of the Site; or (v) any breach of the Terms.
6. OUR PROMOTIONS & COMPETITIONS
6.1 From time to time, Hachette may include competitions, free draws, instant wins, promotions or other offers on the Site (“Promotion(s)”). All Promotions shall be subject to Hachette’s General Competition Terms. Further, each Promotion may be subject to its own express terms and entry requirements which shall feature on or around the entry page of the specific promotion.
7. PRIVACY
7.1 Hachette shall comply with all applicable UK data protection legislation in place from time-to-time in respect of any personal information relation to you gathered by Hachette.
7.2 From time-to-time you may be asked to input basic information, or you may otherwise voluntarily provide the Site with such information, as will be used by us or our service providers for: (i) our internal use, (ii) providing products and services through the Site, (iii) as part of the registration, upload/download process, and/or (iv) as set out on the Site or in our privacy policy.

8. SAFETY
8.1 Please remember posting your name, contact information or any other personal information on the Site places such information in the public domain. Always use caution when giving out information. We advise that you do not reveal any information about yourself or anyone else (for example: full name, telephone number, postal address, email address, home address or any other details that allow you to be personally identified) on the Site.
9. GENERAL
9.1 In the event that any part of these Terms is held to be invalid or unenforceable such provision(s) shall be severed and deleted from these Terms and the remainder thereof shall remain intact and continue to have full force and effect.
9.2 These Terms form the entire agreement between you and Hachette and supersede any other oral or written communications, agreements or representations regarding your use of the Site.
9.3 The Site is intended only to be accessed from the United Kingdom. Hachette makes no representation that the Site content is appropriate or available for use at other locations and access them from other territories where their contents are illegal or strictly prohibited. If you access the Site and you are outside of the United Kingdom you are responsible for compliance with local laws.
9.4 You agree that Hachette reserves the right at all times to disclose any information it deems necessary to satisfy any domestic or foreign applicable law, regulation, legal process or governmental request, or to edit, refuse to post or remove any information, Contribution(s) or materials, in whole or in part.
9.5 Nothing in these Terms shall restrict or exclude any liability that Hachette has to any party which cannot be excluded by law.
9.6 These Terms shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction.
Hachette General Competition Terms and Conditions
These rules apply to all prize promotions including free draws, promotions, prize competitions, instant wins and other offers run by Hachette or partners on the Site (“Promotions”). Please note some Promotions may also be subject to their own express terms and entry requirements which shall feature on or around the entry page of the specific promotion.
- Prize draws and promotions are open to all residents of the UK and Eire, except employees of Hachette and the promoter, the promoter’s advertising agency and sales promotion consultancy, and anyone else connected with the creation and administration of the promotion (and any immediate family of the same).
- Prizes are non-transferable, non-negotiable and no cash alternatives will be offered.
- Hachette reserves the right to substitute the prize for another prize of equal value.
- By entering the competition you accept that Hachette Filipacchi (UK) Ltd. may pass your personal information to the promoters and their data processors. However, Hachette shall use reasonable efforts to ensure that those parties adhere to the same security procedures that we follow ourselves (see the Privacy Policy).
- It is assumed that by entering competitions, which, if won, could result in time off work, your employer or school/college is in agreement. By entering any date-related competition Hachette or the third party are not liable in any way to any winner who cannot attend, and no cash alternative or equivalent prize will be given.
- Winners will be notified by email or by telephone soon after the draw. Winners have five (5) business working days to respond in full to the email or another winner will be drawn.
- By entering the promotion, the winner(s) consents to any publicity generated as a result of the promotion, and use at any time on the Elle Decoration website and related magazine.
- Hachette’s decision in all matters relating to Elle Decoration competitions and promotions is final and no correspondence will be entered into. Odds of winning depend on the number of eligible entries received. Only one entry is allowed per person and spammers will be disqualified.
- Hachette will not accept responsibility for any entries not received through technical fault, incomplete, illegible or other damaged entries. Proof of entry is not automatically proof of receipt.

Hachette/they reserve the right in our/their sole discretion to substitute any and all prizes with prizes of a comparable value, but Hachette shall have no obligation to do so. - The winner of any competition which includes attending a specific venue is responsible for their own travel arrangements unless stated otherwise. If travel is included in the prize, all booking formalities must be completed directly with the travel sponsor and Hachette shall have no responsibility or liability in respect of any travel arrangements.
- Hachette makes no warranty, express or implied, as to the merchantability or fitness for purpose of any prize offered as a result of any Elle Decoration competition or promotion.

a. Hachette will ask you for information, including some personal information, if you use one of several services:
i. Becoming a registered user. In order to register, you need to share some personal information, such as your name and e-mail address. You do not have to be a registered user to visit the Site. But, you may have to register if you want to enter competitions or promotions, receive special discounts, join and engage on discussion forums, otherwise engage with the Sites or make full use of our services. Once you register, you will have an account with Hachette and a password to access that account. 3. HACHETTE’S USE OF WEB BEACONS
a. We have included web beacons on some of our web pages. Hachette uses web beacons to transfer data (such as site usage history). Hachette may provide this data to companies that assist Hachette in data research and analysis; these companies are prohibited from using this data for any other purpose. The analysis and research helps Hachette to determine customer preferences and improve Hachette’s offerings. Hachette may also rely upon third parties to assist with the use and implementation of the web beacons.
b. Definition of web beacon: A web beacon, sometimes called a pixel, is a graphic image or small string of code, that is included on web pages or in an email to enable the transfer of data. Web beacons can be used by companies for several purposes such as reporting web site traffic, customer preferences, advertising effectiveness, and general auditing.
4. USES WE MAKE OF YOUR DATA
a. Hachette may share your personal information with companies that perform services for us, such as sending postal mail and e-mails, analysing and researching customer data, providing marketing assistance, processing, investigating fraudulent activity, serving ads, conducting customer surveys, and providing customer service. They have access to personal information needed to perform their functions, but may not disclose your personally identifiable information for other purposes.

iv. If Hachette or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.

This includes exchanging information with other companies for the purposes of fraud protection and credit risk reduction.
e. We may also collect your personal information for marketing purposes. If you do not want us to use your data for marketing purposes or to pass you details to third parties for such purpose, please tick or untick the relevant box situated on the form on which we collect your data (for example, a registration or order form). By allowing us to use your data, you agree to allow Hachette or one of our selected partners to contact you about promotional offers, products and/or services by email or SMS. When you give us information about another person, you confirm that they have appointed you to act for them, and as such, that you consent to the processing of their personal data, including personal data, to the transfer of their information abroad and to the receipt on their behalf, of any relevant data protection notices.
f. You may also exercise your right to opt out of the use of your information for marketing purposes by Hachette, or by a selected third party company at any time by contacting us.
5. WHERE WE STORE YOUR DATA
a. By using this website you consent to:
i. our processing of your personal data for the above purposes; and
ii. our transferring of your information to countries which do not provide the same level of data protection as the UK if necessary for the above purposes. If we do make such a transfer we will put a contract in place to ensure your information is protected.
6. SOCIAL MEDIA/SOCIAL COMMERCE AND OTHER THIRD PARTIES
a. We work with trusted third parties, including social network sites like Facebook, and with application developers who specialise in social media so we can connect to your social networks. Other social networks we use include Twitter, MySpace and You Tube. All of these companies operate Third Party Sites. We provide access to our Sites by third parties and business partners so we can generate interest in our products and services among members of your social networks and to allow you to share product and service interests with friends in your network.
b. The use of any features made available to you on the Site by a third party may result in information being collected or shared about you by us or by the third party. Information collected or shared through any such third party features is considered “public information” by us because the Third Party Sites made it publicly available. If you do not want us to be able to access information about you from Third Party Sites, you must instruct Third Party Sites not to share the information. We cannot control how your data is collected, stored, used or shared by Third Party Sites or to whom it is disclosed. Please be sure to review the privacy policies and privacy settings on your social networking sites to make sure you understand the information they are sharing. i Facebook’s “Like” feature is a good example. (Other third parties have or may have similar ways for you to express positive opinions about products and services – now or in the future.) We have agreed to allow Facebook’s “Like” feature to run alongside images of our products so you can “like” products and to see how many other Facebook users “like” products featured on our Sites. You should know that Facebook may collect or register the fact that you “like” a product and may post that information to your “News Feed” on Facebook and to your Facebook profile’s “Wall” and “Info” pages. So, the fact that you “like” one or more products may be made known to members of your Facebook network. This would be true for your friends too. If they “like” one of our products, you will see it on his or her News Feed, Wall or Info pages.
Ii Finally, by “liking” products featured on our Sites, you consent to the display of that information by us. We reserve the right to remove the information of any person which we deem to be inconsistent with our ideals or otherwise inappropriate for public association with our company. We may remove from the Site, in our sole discretion, any product or service offering or any photo or product description relating thereto.
7. ACCESS TO INFORMATION
a. The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.
